The community council considered the application after carrying out a site inspection. It was resolved the site does not follow the National Park guidance.

The development is in conflict with Policy G3

The proposed development will have an unacceptable impact on the properties around the site and an unacceptable impact on the natural beauty of the area. In relation to the design statement headed (community safety) the agent states the development will be visible from many surrounding points. It would also appear this development would be back-land development.

The development is in conflict with Policy G6

ii) The proposed three storey devolvement will not enhance the character of the landscape.

iii) The design is not innovative; the design is overbearing in-relation to the existing properties in its proximity.

vi)The site does not have ease of access which will conflict with the pedestrians and vehicular movement in this location.

The community council has concern over the makeup of the land which is proposed for this development. The location was used over many years to dispose of household waste from open fires within the existing dwellings in Bath Row and Shop Row. The desktop survey submitted by the applicant would appear to be the same survey submitted with previous  applications. The desktop survey clearly states the agent cannot provide any evidence to show the land is stable for development. This is indicated in section 3 of the desktop report.

This desktop survey has not raised any concern over the old holding tank and the overflow pipe which discharges through this land. Residents have concern relating to flooding from this disused tank and pipe.     

Highways concerns

The proposed development will have to use a narrow road linked to the network which also has constraints due to residents parking on the highway. The highway has no footway and the infrastructure does not lend itself to more development. The NPA policy ES39 in this case cannot be met due to the physical structures which remain in the ownership of third parties.

The access to the proposed development will need to use a footpath maintained by the local authority. This will have direct conflict with pedestrians and vehicular use by the occupiers of the proposed development. This footpath is used by young children and the elderly who use local facilities. The development will provide an extra 50% traffic movement at this point.

The community council would question the point in the access statement “whilst access is reserved for future consideration” can this be made clear by the applicant.    

The community council would object to this application on the observation above.

The proposed Totem sign has an unacceptable impact on the character of the area, and does not follow the NPA policy G5 ii). The retention of the Totem sign is in conflict with the policy as it’s not sensitively located.  The Totem sign is not in scale and it’s not well designed and shows no relation to the character of the adjacent buildings. G5iv) also refers to minimal impact on light pollution. Members consider this sign to have more than a minimal impact.  

Policy G3 v) the retention of the advertising sign will have an unacceptable impact on properties adjacent to the site. Under this policy (x) the lighting from the sign has and will continue to have an impact on the adjacent property which is in conflict with this section of the policy. This is indicated in the application Photo 11 &12

Where any application is sought the planning authority must consider the quality of life. The retention of this Totem sign will be to the detriment of the day to day living and quality of life for local residents.

Llanelly Community Council would invite members from the National Park Planning Committee to visit the site with members from the Community Council to inspect the dangers.

Llanelly Community Council would object to the application on the grounds of road safety which has been identified above if no road safety improvements can be agreed with the applicants.

This is a new access point onto the A4077. You can see from the enclosed photograph that no access existed before the applicant removed the existing wall to create an access point.

Llanelly Community Council objects on the grounds of road safety on a narrow part of the highway.

Llanelly Community Council also has concerns with high traffic movement on this road and the slow moving vehicles moving in and out of this land will create unsafe traffic congestion, on a part of the highway which has a number of bends concealing the access. 

Members of Llanelly Community Council would also like to bring to your attention that an access point east bound from this application has not received consent, into the same parcel of land.

There is an existing access onto this land 50 meters west bound  

BBNP Decision:

Granted 26th March 2012 with 6 conditions. The first two are standard conditions,

Any gates shall be set back at least 10 metres distant from the edge of the adjourning carriageway and shall be constructed so as to be incapable of opening towards the highway,

Within three months of the date of the permission the gateway to the North-West of the approved access shall be permanently closed off in accordance with details to be submitted to and approved in writing by the LPA. The Developer shall only proceed in accordance with the approved plans and shall be maintained as such thereafter.

The access herby approved shall not be used until the visibility splays as indicated on the NP3v2 have been fully provided. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land of the splays so formed in excess of o.9m in height.

Prior to the first beneficial use, the area of the access to be used by vehicles shall be finished in a 40mm bituminous surface course for a distance of 10m from the edge of the adjoining carriageway.
